Cultivate Notice and Acceptable Use Policy

This Notice and Acceptable Use Policy (“Notice”) constitutes a legally binding agreement as of the Effective Date (defined below), governing your access to, and the use of http://www.cultivate.com and any related website owned or operated by Cultivate (“Websites”), and the use of, and registration with, any Cultivate product (such as the Websites) through the websites, a mobile application or through any other means.
You signify your consent to this Notice by: (i) executing an Order Form that references this Notice (ii) clicking on a button or checkbox for the acceptance of this Notice; or (iii) registering to, using or accessing any Cultivate product (such as the Websites), whichever is earlier (the “Effective Date”).
Notice. An organization’s users of Cultivate products include those users that are (i) associated with an email address that is owned or controlled by the organization, or (ii) otherwise controlled by or operating on behalf of, the organization. Therefore, if the domain of the email address associated with your account is owned or controlled by an organization, or your account is otherwise controlled by the organization, you may be rolled into that organization’s account. In either case, you understand that the organization has rights to your account and may for example without limitation: (a) manage your account and your data therein; (b) control your use of the account; and (c) view your usage and profile data.
Communications. By registering with Cultivate, you understand and consent to Cultivate sending you information regarding the Cultivate products, such as: (a) notices about your use; (b) updates to the Cultivate products; (c) administrative messages; and (d) advertising, marketing, and other materials regarding Cultivate products. You may choose to opt-out of receiving advertising and marketing materials by unsubscribing from such communications via the message instructions. Notices emailed to you will be considered given and received when the email is sent by Cultivate. If you do not consent to receive notices (other than advertising and marketing materials) electronically, you must stop using the Cultivate products.
Acceptable Use. Except as otherwise expressly authorized in writing by Cultivate, you may not, nor permit any third party to: (a) translate, disclose, modify, adapt, or create any derivative works based on the Cultivate product; (b) market, sell, sublicense, use, distribute, publish, display, reproduce, rent, lease, loan, assign, provide access or otherwise transfer the Cultivate product to a third party; (c) decompile, disassemble, reverse engineer, or otherwise attempt to derive source code from the Cultivate product (except to the extent expressly permitted by applicable law, and then only upon advance notice to Cultivate); (d) operate the Cultivate product for the benefit of any third party; (e) remove or obscure any product identification or proprietary notices contained in the Cultivate product; (f) publicly disseminate information regarding the performance of the Cultivate product; (g) submit to the Cultivate product any material that contains sensitive or “special categories” of personal data, such as financial or health information or (h) breach or circumvent any security measures, or access non-public areas of the Cultivate product.
Further, you may not, nor permit any third party to: (i) introduce viruses or other harmful components to the Cultivate product; (j) access or use the Cultivate product for competitive purposes; (k) interfere with the integrity or performance of the Cultivate product; (l) use the Cultivate product to advocate hatred against any person or group of people based on their race, religion, ethnicity, sex, gender identity, sexual orientation, disability or impairment; (m) use the Cultivate product to transmit material that is fraudulent, indecent, defamatory or misleading; (n) violate or infringe proprietary, privacy or other rights of any person (o) circumvent contractual usage restrictions (p) access, search or create accounts for the Cultivate product by any means other than Cultivate’s publicly supported interfaces (i.e “scraping” or creating bulk accounts); (q) send unsolicited communications or spam.
As part of Cultivate’s efforts to protect the Cultivate products or customers, or to stop you from breaching this your obligations hereunder, Cultivate retains the right to take action Cultivate deems necessary, such as terminating your account, access, or features, without liability to you, and without limiting any other remedies.
